GENERAL TERMS AND CONDITIONS OF USE OF THE OPEN DATA PORTAL

Dear users of the Open Data Portal,

The Open Data Portal is a central point for access to public sector data in an open format, as well as a place to interact with data users, the business sector, IT sector, academic community and other stakeholders.

The portal is an online platform designed and implemented as a single point of access to a wide range of open data that allows the search, linking, retrieval and reuse of public data for commercial and non-commercial purposes through a common metadata catalog. The key users of open data, in addition to citizens as the broadest group, are the business sector, the non-governmental sector, the IT community, the academic community and the media, for whom this access to data facilitates their work and planning activities, as well as the numerous research they conduct, as well as the development of new solutions and added value.

The administration of the Open Data Portal is carried out by the body responsible for the information society – the Ministry of Public Administration.

A user is any person who visits an open data portal and/or downloads data that is offered in any way.

In order to provide users with the best possible user experience, the administrators of the competent authorities are responsible for constantly updating the open data portal. Users are aware and agree that the form and structure of the data may change from time to time without notice.

Institutions obliged to apply the Law on Free Access to Information are obliged to publish information and data from their competence and are responsible for the accuracy and timeliness of the published content. The Ministry of Public Administration, which manages the technical platform of the Portal, disclaims responsibility related to the accuracy and timeliness of information and data presented on all pages except for data sets within its competence.

It is allowed to place a link to the Open Data Portal on other web presentations.

The Open Data Portal is integrated with the EU Open Data Portal through Harvest, which provided automatic data collection from external sources.

The basic principles of open data:

  • Completeness - the published data should be complete and cover the entirety of the information collected.
  • Originality - the data should be original, i.e. exactly as it was collected.
  • Timeliness - Data should be made available to the public in a timely manner.
  • Availability - Data sets should be accessible in a way that is easy to use. It is recommended that the information be published in such a way that it can be downloaded in its entirety or provided access through standard APIs.
  • Machine readability - information needs to be published in such a way that it can be easily processed by a computer. Data provided in the form of an image, PDF document or DOC format is complicated for automatic machining. An example of a form of machine-readable data is XML or CSV format with appropriate metadata.
  • Non-discrimination - data should be available to everyone, at all times and without giving a reason for access to the data.
  • Use of Open Standards - An open standard refers to having the right to use the format in which the data is provided.
  • Licensing - it is necessary to clearly indicate that the information/data can be used freely without restriction and to indicate how it can be used.
  • Permanence and accessibility of the archive - a principle that refers to the possibility of access to previously published data, the so-called archives, and not only those that were last published.
  • Cost of use - the use of open data is free of charge.

The licenses for the use of the data used in the implementation of the Portal are standard open licenses used throughout the world, the so-called Creative Commons license. More details about licenses can be found in the following section: Licensing of Data Sets.

The use is allowed to an unlimited number of users who use the portal in accordance with these Terms of Use and other instructions of the administrator.

The Administrator may amend the existing Terms of Use without prior notice or consent of the User. The open data portal is available 24/7. The Ministry of Public Administration does not guarantee the availability of the Portal in case of possible network interruptions, errors, other technical faults or interruptions in operation (power supply, etc.) and in case of force majeure.

The Ministry of Public Administration shall take all measures to eliminate technical limitations or possible errors at the technical level.

In order to ensure the quality of use of the portal, the user undertakes to comply with all instructions and other rules of use published on the open data portal.
